Terms of Service

The client agrees to read the terms and conditions carefully and to take full note of them.  The following terms and conditions apply to all orders placed between Anastasia Negroni Zaytseva and the client.  Anastasia Negroni Zaytseva is entitled to change or supplement these general terms and conditions including all possible appendices at any time.  They are deemed to have been agreed upon if they are not immediately contradicted.

General

The subject of these terms is the service of the make-up artist for the contractually agreed purpose.  A contractual relationship comes about exclusively between the make-up artist and the client.  Unless otherwise stated per invoice, the invoice amount is to be paid within 14 days of issue.  Discount is not granted.

Formation of Contract

A booking can be made by phone, email, Instagram or WhatsApp.  Offers are created individually.  Total prices are agreed upon between the client and service provider in advance.  Offers can also be created as free text in email traffic.  If a client has accepted an offer in writing, the contract is deemed to have been concluded.  The contract can be canceled by the client within 7 days of receipt of the booking confirmation without grounds.  The contract includes the location, date, time and the fee amount.

Options

Options are reservations for the work of the stylist on a specified date.  The customer has 3 days after receipt of the offer to accept it.  The option expires immediately after the 3 days have elapsed if a firm booking is possible through a third party and the optioned date does not lead to a firm booking even after consultation with the customer with whom the option was agreed.

External and Ancillary Costs

The client takes on the incidental costs such as expenses, travel expenses and accommodation costs.  If the order originally placed is expanded to include services that were not part of the contract, the make-up artist is entitled to invoice the additional services and additional ancillary costs separately.  The hourly rate will be used for billing.  This also applies if the agreed production time is exceeded, for which the make-up artist is not responsible.

Travel expenses

The travel costs are calculated at €0.50 per km plus VAT.  When traveling, all travel expenses such as train / bus / flight / taxi as well as accommodation costs are to be borne by the customer, unless otherwise agreed.

Order Cancellation and Cancellation Fee

The contract can be canceled within 7 days after receipt of the booking confirmation without grounds.  A reason must then be given if a contract is canceled later than 3 days before the agreed date, without the make-up artist being responsible for this. In this case, the make-up artist is fully entitled to the agreed upon fee and the ancillary and third-party costs incurred up to that point.  If the contract is terminated earlier, the costs are made up as follows:

  • 100% – up to 3 days before the appointment
  • 75% – 4 – 7 days before the appointment
  • 50% – 8 – 14 days before the appointment
  • 25% – from 15 days before the appointment

If no deficiency is reported by the customer during the term of the order, the order is deemed to be free of defects and fulfilled according to the contract.  The fee is due after the end of the order or at the latest at the time of invoicing without deduction of discount.

The make-up artist is entitled to terminate an order without notice – even during ongoing production – if the advance payment agreed in the order is not received on time and/or not in full, the client postpones the production dates, or there is a suspicion that the booking is not seriously maintained by the client ((e.g. by no feedback/answer from the client to attempts from the makeup artist to contact on the various media over a period of at least 7 days) and/or by blocking the appointment other, serious booking – and thus also fee losses are foreseeable.

Loss of Performance

If the booked stylist cannot perform the styling service due to force majeure (e.g. accident, illness, etc.) or other circumstances for which she is not responsible, the stylist will do her best to find an adequate replacement.  In this case, the stylist is not liable for any additional costs or damage that may arise.

Warranty

The stylist accepts no liability for any allergic reactions that may occur during or after the use of products.  If allergies are known, the stylist will check the products for these ingredients.  Furthermore, the stylist assumes no liability for damage to the styling (due to storms or the like).

Attribution

The make-up artist has the right to be named as the author when her work (including test shoots and editorials) is used.

Test Shootings

The following special features apply to so-called test shootings: If the make-up artist receives no or only a small fee for her participation in a test shooting, the photographs taken during the test shooting etc. are later used for other purposes (advertising), the make-up artist is entitled to an additional reasonable fee.  The appropriateness of the fee is based on the artist’s fee usually paid for the use and on the realized proceeds of the client.

Use of Imagery

The make-up artist is entitled to use the photographs, films, analogue and digital data carriers or prints and copies thereof, for the production of which she has performed his work, for self-promotion, this means:  in particular to publish it in the form of a mailing or on the Internet or to show it as a work sample.  In this case, the client is also responsible for ensuring that the photo model (or photo models) shown agrees to the use mentioned by the makeup artist.

Severability Clause

Subsidiary agreements or agreements that deviate from these conditions must be in writing.  If a provision of the contract or these contractual conditions become ineffective, this does not affect the validity of the remaining conditions and the contract.  Instead of an ineffective provision, that which comes as close as possible to the intended purpose shall be deemed to have been agreed.  The same applies to the filling of gaps in the contract.  The law of the Federal Republic of Austria applies as agreed, also for deliveries abroad.  Place of performance and place of jurisdiction is, as far as legally permissible, the place of business of the make-up artist.

Special features of bridal styling:

Trial

Appointments for trials are to be arranged personally and are available during the week as well as on Sundays.  Trial appointments take place no earlier than 1 to 2 months before the wedding date (exceptions are possible for brides living abroad) and take place at the stylist’s place of residence. Payment for the trial is to be paid after the trial in cash, Paypal or by the banc transfer within max. of 3 days after the date of the Trial.

Order Cancellation and Cancellation Fee

If the contract is terminated up to 48 hours after the trial date, there are no further costs. The deposit for the trial will be retained.

If the contract is terminated later, the costs are made up as follows:

  • 100% – up to 7 days before the wedding date
  • 70% – 7 – 14 days before the wedding date
  • 50% – from 48 hours after the trial up to 14 days before the wedding date
  • 25% – before the trial or by the booking without a trial
